Cannla Policy on Prohibited Items

You are fully responsible for ensuring that any item you list for auction or sale on our Website is not illegal or otherwise prohibited by law.  When in doubt, you should seek legal advice as to whether a specific item you list on the Website is prohibited by law.

We reserve the right to immediately remove your listing, or terminate, suspend or cancel your Membership if we have reasonable grounds to believe that any item you list on the Website is illegal or illicit, prohibited by applicable laws, offensive (including goods of a defamatory or ethnically objectionable nature), stolen, infringing, or illegally-imported.

In order to maintain the Website as a safe trading place for the Members, you are encouraged to report any violation of this Policy by sending an email to contact@cannla.com.

For your guidance, Cannla has endeavoured to provide you with a list of items which are prohibited and/or regulated under the laws of Singapore, or are otherwise prohibited for listing in the Website.  This list is not exhaustive and Cannla does not take responsibility for any item listed and/or sold through the Website which is not on this list but is otherwise prohibited or regulated by law.  By providing this list, Cannla does not purport to give you legal advice on whether the items you list are licit, and you should seek specific legal advise when in doubt.

1.       Adult Material

 

The listing of erotica, or sexually-oriented, or otherwise obscene, materials is prohibited.

The Penal Code (Chapter 224) defines “obscene”, in relation to any thing or matter, as any thing or matter the effect of which is, if taken as a whole, such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it.

 

2.       Alcohol

 

Selling, offering for sale, or permitting to be sold or offered, any intoxicating liquors without a license granted by the Liquors Licensing Board in Singapore are prohibited.

 

3.       Animals and Wildlife Products

Importing, selling, offering for sale, advertising for sale, or displaying to the public certain species as set forth in Endangered Species (Import and Export) Act without the requisite permit are prohibited.

The importation of certain animals and birds is subject to the restrictions imposed by the Animals and Birds (Importation) Order.

Importation of animal feeds without license is prohibited.

4.       Counterfeit Currency and Stamps

 

Selling and importing counterfeit currency, coins, bank notes and Government stamps as well as equipment designed to make these products are prohibited.

 

Sales of reproductions of images of the current series of Singapore notes and coins are regulated by the Monetary Authority of Singapore (“MAS”).

5.       Drugs & Drug Paraphernalia

Narcotics, steroids or other controlled drugs and drug paraphernalia may not be listed for sale.

Drug paraphernalia includes (a) any equipment, materials or substances useful for manufacturing controlled drugs and (b) any and all items that are intended for the smoking, administration or consumption of a controlled drug.

 

6.       Electronic Equipments

Certain electronics equipment, including equipment prohibited by the Info-communications Development Authority of Singapore, is not permitted to be listed online for sale.

7.       Embargoed Goods and Prohibited Countries

The sale of certain types of items from particular countries (including Rwanda, Liberia, Sierra Leone, Iraq, Cote d’Ivoire, Sudan, Congo, etc.) is prohibited.

8.       Government IDs and Licenses

Government IDs and licenses, or items that claim to be, or that look similar to, government identification documents are not permitted to be listed for sale.

9.       Hazardous, Restricted and Perishable Items

Hazardous or dangerous goods (such as radioactive materials, flammable gases, liquids and solids, and toxic substances) cannot be posted through the mail or commercial carriers at all. Items of such nature are not permitted to be listed online for sale.

 

10.   Human Parts and Remains

The sale of humans, the human body, any human body parts or human remains is prohibited.

However, items that contain human hair (such as lockets) as well as skulls and skeletons that are used for medical purposes may be listed.

The following activities are prohibited in Singapore:

·         The trading of human corpses or remains,

·         The trading in organs and blood, and

·         The commercial trading in human eggs, embryos, etc which can be used for the purposes of certain reproductive technologies.

11.   Lockpicking Devices

The sale of any lockpicking or locksmithing device is prohibited.

12.   Lottery Tickets

The listing of the sale of lottery tickets is prohibited.

13.   Mailing Lists and Personal Information

The sale of bulk email, Internet Protocol (IP), Instant Messenger (IM), or mailing lists that contain names, addresses, phone numbers, or other personal identifying information is prohibited. Any tools or software designed predominantly to send unsolicited commercial messages (UCE or "spam") are generally not permitted for listing as well.

14.   Multi-level Marketing, Pyramid and Matrix Programs

The listing and advertising of multi-level marketing programs (including online payment randomisers), matrix, pyramid, Ponzi schemes, and all similar programs are prohibited.

15.   Offensive Materials

The sale of ethnically or racially offensive materials that promote or glorify hatred, violence, or racial intolerance, or items that promote organizations with such views, is prohibited.

16.   Poisons

 

The importation or sale of poisons without license is prohibited.

17.   Police-related Items

The sale of law enforcement badges or official law enforcement equipment from any public entity, including badges issued by the government of any country, is prohibited.

18.   Postage Meters and Franking Machines

The sell, offer for sale, import or export any ‘franking machine’ without the written approval of the Info-communications Development Authority of Singapore are prohibited.

19.   Prescription Drugs

Controlled drugs or items (or their components) that require a prescription from a licensed practitioner (such as a doctor, dentist, ophthalmologist or optometrist) are not permitted for listing online, which includes drugs prescribed by veterinarians for animals.

20.   Prohibited Services

Sellers are not permitted to offer or solicit services online that are sexual in nature.

21.   Recalled Items

 

The listing of items that have been identified by the Standards, Productivity and Innovation Board (SPRING Singapore) as “controlled goods” which do not have a valid SAFETY Mark on the product or packaging is generally prohibited.

22.   Replica, Counterfeit Items and Unauthorized Copies

Counterfeits, unauthorized replicas, unauthorized items (such as counterfeit watches, handbags, or other accessories) or unauthorized copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted.

 

Unauthorized copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged.

 

23.   Slot Machines

The sale of coin-operated slot machines is prohibited.

24.   Strategic Goods and Strategic Goods Technology

 

The transfer and brokering of strategic goods and strategic goods technology are regulated by the Strategic Goods (Control) Act.

25.   Fraudulent Stamps

The sale of stamps that are fraudulent or improperly described is prohibited.

26.   Stocks and Other Securities

The sale of shares, stock or other securities is regulated by the MAS.

27.   Stolen Property

The sale of stolen property is prohibited.

28.   Terrorism-related Supplies and Services

 

It is prohibited to provide resources and services for the benefit of terrorists, to sell or supply etc. arms and related materials to terrorists, or to provide technical advice, assistance etc related to military activities of terrorists.

29.   Tobacco

The sale of tobacco products is highly regulated and is not permitted for listing.
